Worker accommodation terms, explained clearly.

Accommodation

A building or part of a building provided for employees to live in. The exact statutory meaning and requirements depend on the applicable Malaysian jurisdiction.

Accommodation Certificate

The term used in current Sabah and Sarawak labour-department guidance for the certificate required before covered worker accommodation is operated.

Act 446

The Employees’ Minimum Standards of Housing, Accommodations and Amenities Act 1990. Its worker-accommodation framework applies in Peninsular Malaysia and the Federal Territory of Labuan, subject to the current law and regulations.

Centralised accommodation

Under Act 446, accommodation provided to employees of one or more employers. It is commonly discussed commercially as CLQ.

Centralised accommodation provider

A party that provides and manages centralised accommodation and supervises its services for one or more employers. An employer housing only its own employees is excluded from this definition under Act 446.

Centralised Labour Quarters (CLQ)

A commonly used industry and planning term for organised worker accommodation developed or managed as a centralised facility. The legal approval position depends on the actual property and jurisdiction.

Certificate for Accommodation

The certificate required under Part IIIA of Act 446 before covered accommodation is provided to employees in Peninsular Malaysia or Labuan.

Certificate of Completion and Compliance (CCC)

A Malaysian building-completion document issued through the relevant professional certification process. It does not by itself establish that a property is approved for worker accommodation.

Dormitory accommodation

A sleeping arrangement where workers are housed in a dormitory format. The 2020 Act 446 regulations prescribe a minimum sleeping area and personal facilities for this arrangement.

Employer

The party employing the worker. Using an external accommodation provider does not automatically remove the employer’s own notification, oversight and worker-related responsibilities.

Housing

A term used separately from accommodation in the Sabah and Sarawak labour frameworks, particularly in relation to estate or specified employment settings.

JTK Sabah

The Sabah Department of Labour, the state authority responsible for labour administration and the Sabah worker-accommodation framework.

JTK Sarawak

The Sarawak Department of Labour, the state authority responsible for labour administration and the Sarawak worker-accommodation framework.

JTKSM

Jabatan Tenaga Kerja Semenanjung Malaysia, or the Department of Labour Peninsular Malaysia.

Local authority

The relevant city council, municipal council or district council responsible for local planning, building, licensing and related property matters.

Non-dormitory accommodation

Accommodation arranged in rooms or units rather than a dormitory format. The applicable minimum sleeping area differs from dormitory accommodation under the 2020 regulations.

Perakuan Penginapan

The Bahasa Malaysia term commonly used for the Certificate for Accommodation or Accommodation Certificate, depending on the jurisdiction and authority document.

Person in charge

A person appointed by an employer or centralised accommodation provider under Act 446 to manage the accommodation, worker well-being, inspections, health complaints and records.

Temporary Labour Quarters (TLQ)

Temporary worker accommodation commonly associated with a construction project or time-limited worksite. It is not automatically interchangeable with a permanent or semi-permanent CLQ.

Worker hostel

A broad everyday description for worker lodging. The term alone does not establish whether the property is a certified CLQ, employer accommodation, TLQ or another arrangement.
